Penalties, Prior Disclosures and Liquidated Damages

The assessment of penalties and liquidated damages present some of the most stress-inducing circumstances in the life of any importer and can have a substantial financial impact. This presentation will focus on the most typical circumstances which may lead to the assessment of penalties and liquidated damages against your importer customers. The submission of prior disclosures as a means to limit penalty liability will be discussed in detail. Also addressed will be the legal distinctions between penalties and liquidated damages and the means to obtain mitigation of penalties and liquidated damages once they have been assessed or claimed by CBP.
